Memoir Terms of Service

1. Agreement and the service

These Terms govern your use of Memoir, a service for keeping a personal journal of memories, photos, and meaningful dates that you may share with one invited partner. By creating an account or using Memoir after these Terms are made available to you, you agree to them. If you do not agree, do not use the service. Our Privacy Policy explains how information is handled.

The current service is a free pilot. Features and capacity may change, subject to Section 11. A journal can have one or two members, and each member may have one active journal at a time. Archived journals remain available in the app as described below.

2. Eligibility and accounts

You must be at least 18 and legally able to agree to these Terms in India. You sign in through Apple or Google using an account handled by Clerk. You are responsible for keeping access to that sign-in account secure and for activity under your Memoir account. Give accurate profile information and keep it current. Notify us at memoir@zohomail.in if you believe your account has been accessed without permission.

Do not use another person's identity or sign-in credentials without their authorization. Each person should use their own account when sharing a journal.

3. Shared journals and invitations

You may create a journal and invite one partner using an invitation code. Codes expire after seven days and can be revoked before use. Share a code only with the intended person. A person who joins can access the shared journal, including the other member's memories and photos, and can make changes within the app. Each member is responsible for deciding what to add and for obtaining the other person's permission before uploading their private material. Memoir's access controls restrict journals to their members, but they cannot prevent a member from saving, copying, or sharing material they can view.

Archiving a journal removes it from the active journal area; it is not the same as deleting it. Reopening a shared archived journal requires both partners' approval. A member may remove an archived journal from their own view without deleting the other member's data. If an account is deleted, its shared journals are archived for the remaining partner and cannot be reopened through that deleted account.

4. Your content

You retain whatever rights you have in the names, text, photos, dates, and other material you submit (“Your Content”). You are responsible for Your Content and for having the rights and consents needed to submit it and share it with your partner. Do not upload material that infringes another person's rights or is unlawful.

Content license: You grant Abhishek Mishra a non-exclusive, worldwide license to host, store, copy, process, resize, display, and transmit Your Content solely to operate Memoir, make it available to the journal's members, maintain security, and carry out your deletion choices. This license lasts while Your Content is held in the service and ends when it is deleted, except where a copy must be retained under applicable law. You also permit your invited partner to view and use Your Content within the shared journal. This does not transfer ownership of Your Content to us.

Memoir stores journal content in the cloud; it is not end-to-end encrypted. Do not use the service as your only copy of important material. The app offers photo download tools, but their availability can depend on your device and permissions.

5. Free plan and technical limits

The current plan is free. Plus and Premium are described in the app as coming soon and cannot currently be purchased. There are no subscription charges, auto-renewals, or refund rules under these Terms. If paid plans are introduced, their price and purchase terms must be shown and accepted before a charge.

Current enforced limits are 160 photos and 200 MiB of cloud photo storage per person across active and past journals; a 10 MiB maximum per uploaded photo; ten photos and 5,000 characters per memory; 500 memories and 100 reminders per journal; and one active journal per person. Photo uploads accept JPEG, PNG, and WebP. A separate, shared 800 MiB pilot capacity can temporarily stop new photo uploads even when you have personal allowance left. Text memories may still be available when photo storage is full. We may adjust limits under Section 10; we will not present an unavailable paid allowance as purchased capacity.

6. Acceptable use

Use Memoir lawfully and respectfully. Do not submit content you lack permission to use; use the service to threaten, harass, exploit, or violate another person's privacy; try to access another journal or account without authorization; interfere with the service or its security; or bypass the limits in Section 5. Technical requests that violate access or capacity rules may be rejected automatically. We may restrict access for serious misuse, including harassment, unlawful content, or attempts to access someone else's account or journal.

7. Deletion, offline changes, and ending use

You may move memories to Recently Deleted. They can normally be restored for 30 days and are then scheduled for permanent deletion; you can permanently delete them sooner. Archiving a journal permanently clears memories already in Recently Deleted. Existing memory edits may be saved on your device while offline and shared when Memoir reconnects; new memories and photo uploads need an internet connection. An offline edit may fail to sync if the journal or the same memory changed. Check its sync status before relying on it.

You can request account deletion in the app. The process removes your profile, your memory text and uploaded photos, and removes or changes milestones attributed to you, including material in archived journals and Recently Deleted. In a partner-retained journal, a milestone may remain with its name replaced by “Shared milestone” and its author changed to the remaining partner. Solo journals are removed. In a shared journal, your partner's own content remains in their permanently archived copy; some shared records may be retained or changed so that copy remains usable. Deletion also removes your Clerk account and local app data on that device when the process completes. Photos already saved in a device's own gallery are outside Memoir's deletion process. If deletion fails, retry or contact memoir@zohomail.in.

You may stop using Memoir at any time. Deleting the app alone does not delete your cloud account or content. If we suspend or terminate your access for serious misuse, we will email an explanation to your account address and explain how to appeal at memoir@zohomail.in. We may restrict access immediately where an urgent safety or security issue requires it. Restriction does not itself delete your content. If you cannot use the in-app account controls while restricted, contact us about access or deletion requests.

8. Our service and third parties

We and our licensors retain rights in the Memoir app, design, trademarks, and software, excluding Your Content. Subject to these Terms, you may use the app for your personal use. You may not claim ownership of or misuse our branding or software.

Apple and Google provide sign-in options, Clerk handles accounts, and Convex provides backend and storage infrastructure. Device operating systems provide photo access and local notifications. Your direct use of those providers may be subject to their own terms; we do not control them. Local reminders depend on device permission and scheduling and may be delayed or missed. Memoir does not currently generate AI-written content or advice.

9. Availability, warranties, and liability

Memoir is provided as available. We cannot promise uninterrupted access, error-free syncing, delivery of every reminder, or preservation of every item. To the extent permitted by applicable law, Abhishek Mishra disclaims implied warranties that may lawfully be disclaimed. Nothing here excludes a consumer right or remedy that cannot legally be excluded.

To the extent permitted by applicable law, Abhishek Mishra is not liable for indirect or consequential losses arising from use of Memoir. These Terms do not impose a fixed monetary cap on liability and do not limit liability where the law forbids it.

10. Changes to the service or these Terms

We may change Memoir or these Terms. For material changes to these Terms or to storage and access rules, we will provide notice by email and in the app at least 14 days before the change takes effect, unless an urgent legal or security reason requires faster action. The updated Terms will show a new effective date. If you do not accept a change, stop using the service and use the in-app deletion controls if you want your account removed. Changes do not retroactively create a paid obligation.

11. Governing law, disputes, and contact

These Terms are governed by the laws of India, subject to mandatory consumer protections that apply where you live. Courts in Delhi, India will hear disputes, unless applicable law requires another forum.
